A) Privacy policy App users (Employees/Contractors of NDIS/ Aged Care providers)
1. By using the App, You acknowledge and agree that:
(a) We will collect any Personal Information (employee/contractor related information) You provide to Us or Your NDIS/ Aged Care service provider via the App, and We will manage and deal with this Personal Information in accordance with Our Privacy Policy.
(b) We may share Your Personal Information with any NDIS/ Aged Care service providers, or with whom You manage rostering, compliance or otherwise communicate, with via the App (App & web portal)
(c) the NDIS/ Aged Care service providers You work with, or otherwise communicate to, via the App may have their own policy governing access to this information – Our Privacy Policy does not govern, and we make no representations in relation to, how Your NDIS/ Aged Care service providers or vendors handles Your Personal Information, and You should direct any such enquiries to them directly.
(d) any consent given by You through the App is valid and binding unless and until revoked by You, and a NDIS/ Aged Care service providers or vendors may rely on a consent given through the App without any need to further verify that consent.
(e) We may send You emails, text messages, push notifications and other alerts on behalf of Us or Your NDIS/ Aged Care service providers, for purposes such as rostering, appointment bookings, compliance, training, time sheets, participant management, or other related activities and providing You with Your password to access the App;
(f) We may also collect browsing information about You from Your use of Our website, which uses cookies (a small tracking code in Your browser) to improve Your experience while browsing. You may manage how You handle cookies in Your browser settings.
(g) We may access and collect Your geo-location for efficient provision of products and services to you.
(h) If, at any time, You provide or upload Personal Information or other information about someone other than Yourself to the App, You warrant that You have that person’s consent to You providing such information (including their Personal Information) to Us for the purpose specified.
(i) You are not allowed to provide access to anyone else this app (including providing anyone else with Your login details to the App) without written consent from the NDIS/ Aged care providers or directly from us.
(j) If You suspect any misuse or loss of, or unauthorised access to or disclosure of, Personal Information in connection with the App, You must let us know immediately.
B)Privacy policy- NDIS/Aged Care providers (who use this platform manage their employees/contractors)
1. You acknowledge and agree that:
(a) in order to provide You and Your Employees/Contractors with access to and the functionality of the Platform ( web portal and mobile App), we may need to collect and use the Personal Information of You and your employees/contractors.
(b) We will collect and handle any Personal Information and NDIS/Aged Care service providers and their employees/contractors in accordance with Our Privacy Policy and Our Privacy Policy does not cover or address how You handle any Personal Information. You must ensure that you have, and will continue to maintain, a privacy policy which:
(i) complies with applicable privacy laws; and
(ii) provides an accurate representation to Employees/Contractors about the data flow of any Personal Information which occurs between You and Us and via the Platform;
(c) You must ensure that any Personal Information You create or have access to as a result of Your use of the Platform is collected, handled and retained by You in accordance with applicable privacy laws in relevant jurisdictions.
(d) You must only use or disclose Personal Information which is collected by Us and shared with You for the primary purpose for which that Personal Information was collected (rostering, appointment bookings, compliance, training, time sheets, participant management, or other related activities)
(e) to enable Us to provide you with the full functionality of the Platform and our services, We will collect, synchronise, store and access certain information, including the Personal Information of Your Employees & Contractors.
2. Notwithstanding anything else in these Terms or the Software User Agreement, You must ensure that You have:
(a) obtained all necessary consents from individuals (including Your Employees, Contractors, Participants to your program) whose Personal Information or Healthcare Information may be provided or uploaded to the Platform (including any third-party services facilitated by the Platform) or to Us directly, prior to providing or uploading that Personal Information or Health care Information; and
(b) provided all necessary notifications to such individuals in relation to Our collection of their Personal Information or Healthcare Information, as required by applicable privacy laws.
3. You must:
(a) provide reasonable assistance to the other party in relation to any privacy-related complaints or regulatory enquiries; and
(b) notify the other party upon becoming aware of an Eligible Data Breach with respect to the Personal Information which is shared between the parties.
